Good news for our Amicus

You keep winning!

We (along with Downsize DC Foundation/ZAP) have been fighting on the Fourth Amendment front for years.

We started by submitting the only brief urging the Supreme Court to hear the Antoine Jones case. Then, we were the only party in the Jones case, to raise a property rights argument, while everyone else was writing about privacy expectation.

That case, and Jardines to follow, radically reformed Fourth Amendment jurisprudence. And…

We’ve stayed in the fight, continuing to solidify Jones and push the envelope. For example, in the Collins case, we filed the only amicus asking the Supreme Court to take that case. Then, we returned with a property rights argument that won the day.

Last summer, we announced yet another victory where we’d filed an amicus brief Carpenter, which is already being hailed as a landmark case.

And now…

Our Paul Johnson Jr brief urges the Supreme Court to take the case and schedule a hearing. The issue is the constitutionality of “stop and frisk.”

Once again, we filed the ONLY amicus brief supporting the petition!

There’s breaking news to report… The Solicitor General’s office had waived its right to respond to the Paul Johnson Jr petition. A waiver often indicates that the Solicitor General does not believe the Court will take the petition seriously. But if the Supremes find the case interesting and are seriously considering granting cert, they will order the government to file an opposition brief.

The Supreme Court requested that the government file a response by August 5. A very good sign indeed!

Our new website

Last week, we told you about new software and a new website: Say Goodbye to OLD Downsize DC.

Next week, we’re going to tell you about the “far out” new strategy we’ll be following. It includes an unusual new name.

We reported that… The new website is funded. The software package is also paid for. Then, someone gave me remarkable advice…

If you don’t need the money, there’s no need to give people these details. Just build it.

Well, we didn’t say we don’t need money! There’s been less than $900 spent on outreach in the last nine months. That’s insufficient to the point of unhealthy. And the new message website we’re launching (next month) needs explosive, early attention.

    I appreciate all the efforts and hope for successes. However, I believe the first question that should be addressed it the Marc Stevens/Lysander Spooner question: What factual evidence do you, judge, prosecutor, politician, IRS agent or anyone, have that the constitution and law apply to me just because I am physically present in some state. As a start one should at the very least submit an affidavit of truth stating what, when, where, why, how and by whom one was “made” subject to the jurisdiction thereof. Citizenship cannot be compelled else we are slaves on the plantation state. Agreements made in which the government did not disclose up front all the conditions, benefits and dangers and disbenefits is nul and void ab initio.
